In English (Question & Model Answer)

Clarify the legal form of the domestic violence and the protection of women from it in India.

Introduction: Domestic violence represents one of the most pervasive human rights violations within the private sphere. To provide a comprehensive civil and human rights remedy, the Parliament enacted the Protection of Women from Domestic Violence Act, 2005 (PWDVA, 2005) pursuant to Article 15(3) of the Constitution and the UN Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW).

1. Legal Form and Comprehensive Definition of Domestic Violence (Section 3):

The Act departs from narrow criminal definitions and covers any act, omission, or conduct of the respondent that harms, injures, or endangers the health, safety, life, limb, or well-being (mental or physical) of an aggrieved woman living in a "domestic relationship" within a "shared household":

  • Physical Abuse: Any act or conduct causing bodily pain, harm, or danger to life, limb, or health, including assault, battery, and criminal intimidation.
  • Sexual Abuse: Any conduct of a sexual nature that abuses, humiliates, degrades, or otherwise violates the dignity of woman.
  • Verbal and Emotional Abuse: Insults, ridicule, humiliation, name-calling, repeated insults regarding lack of children or male child, and threats of physical pain.
  • Economic Abuse: Deprivation of all economic or financial resources to which the aggrieved woman is entitled, prohibition of access to household resources, alienation of stridhan, or non-payment of maintenance.

2. Multi-Tier Institutional Machinery for Protection:

  • Protection Officers (Section 8): Dedicated state-appointed officers in each district to assist the Magistrate, ensure legal aid, and prepare Domestic Incident Reports (DIR).
  • Service Providers (Section 10): Registered voluntary organizations providing medical aid, shelter, and legal counseling.
  • Shelter Homes & Medical Facilities (Sections 6 & 7): Statutory right to secure shelter and free medical treatment.

3. Comprehensive Statutory Reliefs / Judicial Orders (Sections 18–22):

  • Right to Reside in Shared Household (Section 17): Absolute protection against unlawful eviction or dispossession from the matrimonial/shared home.
  • Protection Orders (Section 18): Restraining the abuser from committing violence, entering her workplace, or contacting her.
  • Residence Orders (Section 19): Directing the respondent to remove himself from the shared household or secure alternative accommodation for the woman.
  • Monetary Reliefs (Section 20): Directing reimbursement of medical expenses, compensation for loss of earnings/property, and maintenance.
  • Custody Orders (Section 21): Granting temporary custody of children to the mother.
  • Compensation Orders (Section 22): Awarding damages for mental trauma and emotional distress.
  • Penal Enforcement (Section 31): Breach of protection order is a cognizable and non-bailable criminal offence punishable with up to 1 year imprisonment or ₹20,000 fine.

Conclusion: PWDVA 2005 transformed gender jurisprudence from punitive criminal retribution to emergency victim support and socio-economic rehabilitation. Integrating the Act with Sakhi One Stop Centres and fast-track disposal is essential for zero tolerance against domestic abuse.
