लोक सेवा आयोग के कार्य एवं सदस्यों पर पद धारण करने संबंधी संवैधानिक प्रतिषेध (अनुच्छेद 315-323)
भारतीय संविधान के भाग XIV के अंतर्गत संघ लोक सेवा आयोग (UPSC) एवं राज्य लोक सेवा आयोग (जैसे MPPSC) को योग्यता प्रणाली का संरक्षक (Watchdog of Merit System) बनाया गया है।
1. लोक सेवा आयोग के प्रमुख कार्य (अनुच्छेद 320):
- प्रतियोगी परीक्षाओं का आयोजन: संघ अथवा राज्य की सिविल सेवाओं एवं पदों पर नियुक्ति हेतु परीक्षाओं तथा साक्षात्कारों का संचालन करना (उदा. MPPSC राज्य सेवा परीक्षा)।
- परामर्शदात्री कार्य (शासन द्वारा अनिवार्य परामर्श):
- सिविल सेवाओं एवं पदों के लिए भर्ती की पद्धतियों से संबंधित सभी विषयों पर।
- सिविल पदों पर नियुक्ति, पदोन्नति तथा एक सेवा से दूसरी सेवा में स्थानांतरण के सिद्धांतों पर।
- सिविल सेवकों पर प्रभाव डालने वाले सभी अनुशासनात्मक मामलों (वेतन वृद्धि रोकना, अनिवार्य सेवानिवृत्ति, पदच्युति आदि) पर।
- शासकीय कर्तव्यों के पालन में कानूनी कार्यवाही के विरुद्ध विधिक व्यय की प्रतिपूर्ति के दावों पर।
- असमर्थता अथवा असाधारण पेंशन के दावों पर।
- वार्षिक प्रतिवेदन (अनुच्छेद 323): राष्ट्रपति/राज्यपाल को वार्षिक कार्य प्रतिवेदन प्रस्तुत करना, जिसे विधानमंडल के पटल पर रखा जाता है।
2. सदस्यों द्वारा पद समाप्ति के पश्चात पद धारण पर प्रतिबंध (अनुच्छेद 319):
आयोग की निष्पक्षता और स्वतंत्रता बनाए रखने हेतु सेवानिवृत्ति उपरांत निम्न कठोर प्रतिबंध लागू हैं:
- UPSC का अध्यक्ष: केंद्र या राज्य सरकार के अधीन किसी भी अन्य नियोजन (नौकरी) का पात्र नहीं होगा।
- राज्य लोक सेवा आयोग (SPSC) का अध्यक्ष: केवल UPSC के अध्यक्ष/सदस्य अथवा किसी अन्य राज्य लोक सेवा आयोग के अध्यक्ष पद पर नियुक्त हो सकता है; अन्य किसी पद पर नहीं।
- UPSC का सदस्य: केवल UPSC के अध्यक्ष अथवा SPSC के अध्यक्ष पद हेतु पात्र।
- SPSC का सदस्य: UPSC के अध्यक्ष/सदस्य अथवा उसी या अन्य SPSC के अध्यक्ष पद पर नियुक्त हो सकता है।
- पुनर्नियुक्ति पर रोक: कोई भी सदस्य अपने पद पर दूसरे कार्यकाल हेतु पुनर्नियुक्त नहीं हो सकता (अनुच्छेद 316(3))।

- Chairman of SPSC (e.g., MPPSC): Eligible only for appointment as Chairman or Member of UPSC, or Chairman of any other SPSC. Ineligible for any other government employment.
- Member of UPSC: Eligible only as Chairman of UPSC or Chairman of an SPSC.
- Member of SPSC: Eligible only as Chairman/Member of UPSC or Chairman of that SPSC/other SPSC.
- Non-Reappointment: Members cannot be reappointed to the same post for a second term (Art. 316(3)).
