Veto Powers of the President of India (Article 111):

Under Article 111, when a bill passed by Parliament is presented to the President, he has three constitutional options (except for Money Bills and Constitutional Amendment Bills):

  • 1. Absolute Veto: Withholding assent to a bill passed by Parliament, ending the bill completely (exercised regarding Private Member Bills, or when a Cabinet resigns before assent).
  • 2. Suspensive Veto: Returning a non-money bill to Parliament for reconsideration. If Parliament repasses the bill (with or without amendments) by simple majority, the President must grant assent.
  • 3. Pocket Veto: Neither giving assent nor rejecting nor returning the bill, keeping it pending indefinitely (since the Indian Constitution prescribes no time limit; exercised by President Giani Zail Singh on the Indian Post Office Amendment Bill in 1986).

Constitutional Exception: Under the 24th Amendment (1971), the President has no veto power over Constitutional Amendment Bills (Art. 368).

भारत के राष्ट्रपति की वीटो (निषेधाधिकार) शक्तियां (अनुच्छेद 111):

संसद द्वारा पारित किसी विधेयक के प्रस्तुत होने पर राष्ट्रपति को संविधान के अनुच्छेद 111 के तहत तीन प्रकार की वीटो शक्तियां प्राप्त हैं (धन विधेयक व संविधान संशोधन विधेयकों को छोड़कर):

  • 1. आत्यंतिक वीटो (Absolute Veto): विधेयक पर अपनी स्वीकृति सुरक्षित रखना (मंजूरी न देना), जिससे विधेयक समाप्त हो जाता है (गैर-सरकारी विधेयकों पर अथवा मंत्रिमंडल के त्यागपत्र देने पर)।
  • 2. निलंबनकारी वीटो (Suspensive Veto): गैर-धन विधेयक को पुनर्विचार हेतु संसद को लौटाना। यदि संसद साधारण बहुमत से विधेयक को पुनः पारित कर दे, तो राष्ट्रपति स्वीकृति देने हेतु बाध्य हैं।
  • 3. पॉकेट / जेबी वीटो (Pocket Veto): विधेयक पर न तो सहमति देना, न अस्वीकार करना और न ही लौटाना, बल्कि अनिश्चितकाल हेतु लंबित रखना (1986 में राष्ट्रपति ज्ञानी जैल सिंह द्वारा डाकघर संशोधन विधेयक पर प्रयोग)।

संवैधानिक अपवाद: 24वें संविधान संशोधन (1971) के तहत राष्ट्रपति संविधान संशोधन विधेयक (अनुच्छेद 368) पर वीटो का प्रयोग नहीं कर सकते।
