Introduction: The Protection of Civil Rights Act, 1955 (PCRA, 1955) (originally enacted as the Untouchability (Offences) Act, 1955 and amended in 1976) was legislated pursuant to Article 17 of the Constitution to abolish the practice of untouchability and punish any disability arising therefrom. 1. Scope of Social Disabilities Prohibited under Section 4:

Whoever on the ground of "untouchability" enforces against any person any disability with regard to the following activities commits a cognizable offence:

  • Access to Public Facilities & Services (Sec 4(i)–(iv)):
    • Access to any shop, public restaurant, hotel, or place of public entertainment.
    • The use of any utensils, and other articles kept in any public restaurant, hotel, eating house, or dhaba.
    • The practice of any profession, occupation, trade, or business, or holding any employment.
  • Water Sources & Public Utilities (Sec 4(v)):
    • The use of, or access to, any river, stream, spring, well, tank, cistern, water-tap, or other watering place, or any bathing ghat, burial or cremation ground.
    • The use of, or access to, any sanitary convenience, road, or public path.
  • Public Amenities & Charitable Institutions (Sec 4(vi)–(vii)):
    • The use of, or access to, any place used for a charitable or a public purpose maintained wholly or partly out of State funds or dedicated to the use of the general public.
    • The enjoyment of any benefit under a charitable trust created for the general public.
  • Transport & Residential Accommodations (Sec 4(viii)–(x)):
    • The use of, or access to, any public conveyance (buses, trains, taxis).
    • The construction, acquisition, or occupation of any residential premises in any locality.
    • The observance of any social, religious, or ceremonial custom, or taking part in any religious, social, or cultural procession.
    • The use of jewelry, finery, or riding horses/vehicles during marriage processions.

2. Prescribed Punishments under Section 4:

  • Statutory Penalty: Offender shall be punishable with imprisonment for a term of not less than one month and not more than six months, AND with fine of not less than one hundred rupees and not more than five hundred rupees.
  • Enhanced Penalty for Subsequent Offences (Section 11):
    • Second Offence: Imprisonment from 6 months to 1 year + fine from ₹200 to ₹500.
    • Third or Subsequent Offence: Imprisonment from 1 year to 2 years + fine from ₹500 to ₹1,000.
  • Cognizable and Summary Trial: All offences under the Act are cognizable, non-compoundable, and tried summarily by a Judicial Magistrate First Class.

    • किसी पेशे, व्यवसाय, व्यापार या आजीविका को अपनाने या रोजगार पाने में बाधा डालना।
  • जलस्रोतों एवं सार्वजनिक मार्गों का उपयोग (धारा 4(v)):
    • किसी नदी, झरने, कुएं, तालाब, नल, जलस्रोत, स्नान घाट, श्मशान या कब्रिस्तान के उपयोग या वहां जाने से रोकना।
    • सार्वजनिक शौचालय, सड़क या सार्वजनिक मार्ग के उपयोग से रोकना।
  • परोपकारी संस्थाएं एवं सार्वजनिक सुविधाएं (धारा 4(vi) व (vii)):
    • सरकारी या सार्वजनिक निधि से पोषित किसी परोपकारी संस्था या सार्वजनिक स्थल का उपयोग करने से रोकना।
    • जनसाधारण हेतु बनाए गए किसी धर्मार्थ न्यास (Trust) के लाभों से वंचित करना।
  • परिवहन, आवास एवं सामाजिक उत्सव (धारा 4(viii) से (x)):
    • सार्वजनिक परिवहन के साधनों (बस, टैक्सी आदि) के उपयोग से रोकना।
    • किसी भी मुहल्ले/कॉलोनी में मकान बनाने, खरीदने या निवास करने से रोकना।
    • सामाजिक/धार्मिक जुलूसों में भाग लेने, आभूषण पहनने या विवाह में घोड़ी पर चढ़ने से रोकना।

2. धारा 4 के अंतर्गत विहित दण्ड के प्रावधान:

  • प्रथम अपराध पर दण्ड: न्यूनतम एक माह तथा अधिकतम छह माह का कारावास, तथा न्यूनतम ₹100 एवं अधिकतम ₹500 तक का जुर्माना (दोनों अनिवार्य)।
  • पुनरावृत्ति (बार-बार अपराध) पर कठोर दण्ड (धारा 11):
    • द्वितीय अपराध हेतु: 6 माह से 1 वर्ष तक का कारावास + ₹200 से ₹500 तक जुर्माना।
    • तृतीय या उत्तरवर्ती अपराध हेतु: 1 वर्ष से 2 वर्ष तक का कारावास + ₹500 से ₹1,000 तक जुर्माना।
  • संज्ञेय एवं गैर-शमनीय: अधिनियम के तहत सभी अपराध संज्ञेय (Cognizable) तथा प्रथम श्रेणी न्यायिक मजिस्ट्रेट द्वारा संक्षिप्त विचारणीय (Summary Trial) होते हैं।
